Charging schedule in respect of the Deferred Payment Scheme

The council applies an administrative fee for arranging the Deferred Payment

Agreement which includes legal fees; the cost for placing a charge on the property

with the Land Registry; property valuation(s) and staffing costs. The amount charged for any referrals received with effect from 1st April 2024 is £998. This amount will be charged if you successfully enter onto the Deferred Payment Scheme.

The fee can be paid via invoice when due or the full value can be deferred, in which case it will be subject to interest charges.

If you start the Deferred Payment Scheme application process and then subsequently are not able to or choose not to continue with the application, you will be charged a proportion of the administrative fee as shown below.

These fees are correct as of 1st April 2024 and are subject to review on an annual basis.

*An agreement to repay is used when a person either chooses to or is unable to deal with their own financial affairs and there is no legal representative in place. This agreement allows you a period of time to obtain the appropriate authority and thereafter make an application for the Deferred Payment Scheme. The council may also decide to utilise an agreement to repay for other reasons at their discretion.

**A solicitors undertaking may be used in certain circumstances when a persons' property is sold subject to contract prior to the completion of the application for the Deferred Payment Scheme. This allows the county council to continue making payments to the care home on behalf of the resident, pending the sale of the property. Once the sale has completed, any monies due to the county council are repaid from the proceeds of the sale.
