Land compensation claims

If your home has lost value because of physical factors caused by public works (such as new roads or changes to highways), you may be able to claim compensation under Part 1 of the Land Compensation Act 1973. This applies when no land has been taken from you.

Physical factors include:

  • Noise

  • Vibration

  • Smell

  • Fumes

  • Smoke

  • Artificial light

  • Discharge of solid or liquid substances onto your land

For claims about a highway (road), you can submit your claim one year after the road first opens to public traffic.
