Moving traffic contravention – pay or challenge your penalty charge notice

Moving traffic enforcement helps to improve safety, keep traffic moving, and reduce congestion on roads where violations are frequently observed.

Charges and payment

The standard Penalty Charge Notice (PCN) is £70.

If you pay within 21 days of PCN being served, the charge is reduced by 50% to £35.

If you do not pay within 21 days, you will receive a service of charge certificate, and the charge will increase by 50% to £105.

The Penalty Charge Notice goes to the person believed to be the owner of the vehicle as, under the Traffic Management Act 2004, it is the owner of the vehicle who is liable for any penalty charge notice issued to it, irrespective of who was driving.

We don't accept challenges in person or over the phone due to audit procedures.

We aim to respond to all correspondence within 20 days.

To protect your 21-day 50% discount period, your written representation needs to be received within the first 21-day discount period after the Penalty Charge Notice has been issued. If we receive your representation later than the 21 days, you will be liable to pay the full charge amount should your Penalty Charge Notice be upheld.

State your case clearly and simply. If you have evidence to support your claims such as receipts, please include them. We recommend that you always send copies only and hold on to the originals.

When we have received your correspondence and investigated your case, we will write back to you, either accepting or rejecting your representation.

Should your Penalty Charge Notice be cancelled at this stage, you will receive a letter informing you of this. If it is upheld, you will be sent a letter explaining why, this is called a Notice of Rejection of Representations. This will explain how to appeal to the Independent Parking Adjudicator (Traffic Penalty Tribunal).

Stage two - Appealing to the Independent Parking Adjudicator

You may only appeal to the Independent Parking Adjudicator if you have first made representations to the council and have received the Notice of Rejection of Representations. Your ‘Notice of Rejection of Representations’ will explain how to appeal to the Independent Parking Adjudicator.

The decision made by the independent adjudicator is final and is binding on both the council and the appellant.

If the Independent Parking Adjudicator rejects your appeal, you must pay the penalty charge. Failure to pay the charge will result in debt registration and the pursuit of the charge through the county court and through enforcement agent action.

How we enforce moving traffic offences

Local councils have the power to enforce certain moving traffic offences. These include:

  • turning left, right or making u-turns when instructed not to do so
  • driving the wrong way up one-way streets
  • entering yellow box junctions when the exit is not clear
  • driving where and when motor vehicles are prohibited

These powers do not include speeding which remains the responsibility of the police. We use Automatic Number Plate Recognition (ANPR) technology to identify drivers.

During the first six months of beginning enforcement at a new location we will issue warning notices for a first offence to educate drivers about the contravention that they have committed. If a vehicle is identified contravening the same regulation a second time within this period a Penalty Charge Notice (PCN) will be issued.
