Being detained under the Mental Health Act

Sometimes, when people with a mental health problem or learning disability are unwell they can pose a risk to themselves or to others. Under these circumstances they may be detained in a hospital and treated under the Mental Health Act.

Health and social care professionals should consider and discuss things with you and your family and carer to consider other options first; these may include:

  • a review of any medication you are taking
  • respite care (for example, social services accommodation where you can stay overnight)
  • treatment at home or a crisis house (safe accommodation for people in crisis)
